“The impact of the decision (that  is being appealed) is that Google would need to check whether every advertising link is misleading,” said attorney Sally Scott. “This is not a mechanical exercise that can be performed by technology as it would involve the exercise of judgment. It is not practical for Google to do this given the quantity of its ads.”

Usually, especially in the U.S., when an advertiser wants to run an ad in a newspaper, magazine or on a web site, part of the advertising contract stipulates that the advertiser assumes responsibility for the content of the ad.
