In Mexico, same-sex sexual activity has been decriminalized since 1871, thanks to French influence during the late 19th century and the implementation of the Napoleonic Code. However, despite this early progress, laws against public indecency were sometimes misused to persecute gay individuals. In the 21st century, Mexico has made significant strides towards LGBTQ+ rights. In 2003, the Federal Law to Prevent and Eliminate Discrimination was passed, extending protections to “sexual preferences” as a category. This made Mexico the second Latin American country to implement anti-discrimination laws for the LGBTQ+ community. In 2011, these rights were further solidified by being enshrined in the Mexican Constitution.
