Mr. Powers also has sole voting and dispositive power with respect to 3,861,350 shares owned by commingled funds or mutual funds over which Mr. Powers serves as Portfolio Manager. As CEO and Portfolio Manager of Private Capital Management, LLC ("PCM"), Mr. Powers exercises shared voting and dispositive power with respect to 12,884,243 shares, including shares held by those PCM clients that have delegated proxy authority to PCM. Such delegation may be granted or revoked at any time at the client's discretion.
